Il diritto alla libertà e il suo rovescio

In vista del trentunesimo «Meeting per l'amicizia fra i popoli» che si svolgerà a Rimini dal 22 al 28 agosto, anticipiamo stralci di un articolo a firma del cardinale arcivescovo di Esztergom-Budapest che sarà pubblicato sul prossimo numero di «Atlantide», quadrimestrale della Fondazione per la Sussidiarietà diretto da Giorgio Vittadini.
Oltre venti anni dopo il crollo del Muro di Berlino giova ripensare alla situazione della nostra religione e dei credenti in un'Europa in cui si parla molto di laicità. L'Europa è un continente complicato, dalle mille facce, con diversi peoples and different cultural heritages, different sensibilities, different social positions of religion in general and the Catholic Church in each country. Reflecting on the current situation, taking into account the cultural and sociological elements, we can identify some realities, and perhaps a few possibilities for further development concerning the relationship between church and state in our continent.
The word secularism is very common in the countries of Latin tradition and Catholic Italy, France, Spain and Portugal. It is historically linked with a process of secularization of politics took place in these countries during the modern era. As we all know, this story was marked da aspri conflitti e da fenomeni anche violenti, le cui vittime erano spesso non soltanto i portatori delle antiche strutture politiche, ma anche la gente semplice, tra cui molti credenti. Oggi comunque, in tutti questi Paesi, vige un sistema di netta separazione tra Stato e Chiesa, la cosiddetta «laicità dello Stato».
In un'altra regione del continente, precisamente nel Nord-Europa, dove la religione di Stato durante l'epoca moderna era qualche forma del protestantesimo, la separazione non si è manifestata in forma tanto violenta, ma il processo di secolarizzazione è stato comunque continuo, e ha condotto all'esaurimento delle istituzioni e dei legami religiosi. Le forme istituzionali religiose non sono state rifiutate in modo radicale, ma, con la secolarizzazione della società, pur conservando alcuni simboli religiosi, o magari, anche un ruolo istituzionale interno a qualche comunità religiosa -- come nel caso della Chiesa di Inghilterra -- è stata permessa sempre di più anche la libertà delle altre religioni, e il funzionamento pienamente secolare delle istituzioni pubbliche.
Un terzo gruppo dei Paesi europei è rappresentato dai cosiddetti «Paesi dell'Est». In questi Paesi la lunga oppressione comunista ha separato in modo brutale la religione dallo Stato. Ufficialmente non si annunciava la neutralità dello Stato, ma piuttosto il suo collegamento istituzionale con l'ideologia marxista-leninista, chiamata visione scientifica del mondo, oppure socialismo scientifico, oppure materialismo dialettico e storico. In realtà, tale ideologia aveva pienamente il ruolo di una religione di Stato, fino al punto che in alcuni Paesi la stessa costituzione dichiarava che «la forza guida della società è il partito marxista-leninista della classe operaia». Ciò significava che quelli che non si professavano marxisti-leninisti, avevano meno diritto di partecipare alla direzione della società. Vent'anni dopo il crollo di questo sistema i popoli dei Paesi ex-comunisti hanno attraversato uno sviluppo istituzionale, sociologico e ideologico. La prima novità in questo contesto è stata la libertà di religione, espressa in diverse leggi più o meno fondamentali in questi Paesi.
La Chiesa cattolica, da parte sua, aveva attraversato il periodo del rinnovamento conciliare, aveva precisato il vero senso cattolico della libertà religiosa, e cominciava ad affrontare la sfida del secolarismo con questo atteggiamento. Da parte cattolica, quindi, malgrado alcune nostalgie storiche, provenienti generalmente non dalla Chiesa stessa, ma piuttosto da altri gruppi della società, non ci fu nemmeno un tentativo di ottenere una posizione di religione di Stato.
Nei Paesi di tradizione ortodossa, parallelamente al risveglio di queste Chiese, si poté osservare anche una notevole riservatezza da parte degli organi statali, riguardo a un collegamento completo e ufficiale tra Stato e Chiese nazionali. Occorre notare che, specialmente in Russia, la distruzione della religione e la secolarizzazione erano talmente profonde che un tale collegamento, indipendentemente dalle intenzioni, non sembrava troppo realistico.
In questi ultimi Paesi del Centro-Est europeo, esistevano anche altri fatti culturali più o meno oppressi durante l'epoca comunista. L'elemento etnico o nazionale era uno di questi. Dopo il crollo del sistema si manifestarono più liberamente anche questi elementi di identità. Tale svolta era stata poco preparata anche dal punto di vista psicologico. Perciò scoppiarono conflitti nazionali ed etnici, come in the Caucasus, the Baltic countries in the former Yugoslavia, and in a less violent, even elsewhere in the region. All this was confirmed by the birth or rebirth of many nation states gained their sovereignty after the collapse of the communist federal states. This national phenomenon is connected with religious elements in some parts, having been an integral part of the religion specific culture of different nations. Other specific elements of these cultures often could not grow enough for the pressure of communist.
Europe knows different models of relations between church and state. But he also knows various types of state. Today the prevailing model is still the rule national, a typical product of modern times. But it is a fundamental reality of Europe today that the European Union, which includes a multitude of nation states, and that seems to greatly affect the internal affairs of Member States and also the public. Large states with the greatest variety of peoples, geographically well with other deep-economic differences, linguistic, cultural and religious backgrounds have marked for long periods the history of our continent. Over the last two thousand years, periods without great empires in Europe have been much shorter than those in the sign of those empires.
Chronologically we can begin with the Persian empire, which since the days Darius I (522-486 before Christ) also included Macedonia and Thrace, and therefore, the land that today is considered European. As is known, the Persian Empire at the time of its flowering represented a state ruled according to principles nearly modern. In it the various peoples had considerable freedom of expression of their culture and their religion, rather than the religious and cultural thing, they also had substantial legal autonomy to organize their lives according to their traditions. This situation has its classical precipitation in different books of the Old Testament.
The Roman Empire, for its part, was the bearer of a consciousness of the historical mission of the Roman people, but embedded in its organizational structure elements of the heritage of universal Hellenistic monarchies. In these forms of state was a fundamental phenomenon, the duplicity of the population, namely, the large number of population with Roman culture on the one hand, and on the other hand, the communities from which came the Germanic ruling class. This cultural duality led several kings to enact various laws, different codes for the various communities living in the same state.
Even in the Roman-Germanic, called at certain times of the Holy Roman Empire of the German nation, survived the plurality of the popular rights and also in the collections of tribal customary law. The awakening of the knowledge of Roman law, the end of the eleventh and the twelfth century later, the texts of Justinian Roman law began to affect the high levels of legal life, starting from university. Although this right has been respected especially as ratio scripta, and not as a law fully in force in all the relations of social life, it has influenced the development of European law, and had in many parts of the continent, the function of subsidiary rights that helped to fill the gaps of the laws.

Un capitolo meno remoto è costituito dall'esempio dell'impero sovietico, Stato federale composto da molte repubbliche, il quale aveva però anche una serie di altri Stati un po' meno strettamente dipendenti, ma legati a sé nel quadro del Comecon (Consiglio di mutua assistenza economica) e del Patto di Varsavia. La possibilità dei popoli e gruppi di conservare la propria lingua, cultura e religione fu diversa nei diversi periodi della storia sovietica, e differente nei diversi stati satelliti. Cittadini ungheresi negli anni Settanta guardavano per esempio con grande ammirazione i molti ordini religiosi esistenti legalmente in Polonia.
Anche se la religione costituiva durante la storia un elemento determinante dell'identità etnica dei diversi popoli, nel quadro dei diversi imperi, nella storia si osserva una lunga serie di modalità di trattare questo fenomeno. Trattarlo, per esempio, in modi anche giuridicamente diversi, a seconda delle diversità dei popoli, dei Paesi, delle regioni autonome, delle tradizioni culturali, riconosciute in settori identificabili secondo criteri territoriali e personali. Nello specchio della storia, quindi, un elemento tipico e molto europeo dei rapporti tra Stato e Chiesa sembra essere proprio la diversità.
Prescindendo dalla stragrande diversità nella storia, dobbiamo osservare anche un altro fatto più o meno costante. Nell'epoca moderna poi, cominciò a ricevere nuovi accenti il diritto naturale, interpretato comunque partendo dalla tradizione cristiana, per sfociare poi, all'epoca dell'illuminismo, nei diritti umani classici. Se oggi il contenuto e le basi dei diritti umani cominciano a perdere i loro chiari contorni, allora è giustificata la preoccupazione per le basi comuni, a livello di visione del mondo, della comunità dei popoli europei.
Sorge la domanda tecnica della gestione della libertà e della pluralità. La pluralità non può comprendere senz'altro qualsiasi atteggiamento di violenza o di terrore, la libertà, come vediamo in questi tempi di crisi, può causare la distruzione dei più deboli, e può aprire la strada alle ingiustizie più gravi, se non viene regolata dal principio del bene comune. Ma per identificare un bene comune ci vogliono principi comuni antropologici. Ci vuole una qualche visione comune su che cosa è buono per l'essere umano. E oltre a questo, ci vuole anche una autorità non sprovvista di forza che possa far valere le esigenze del bene comune. La dottrina sociale della Chiesa, arricchita recentemente dall'enciclica Caritas in veritate, è sempre attuale. Il dilemma del liberalismo classico dell'inizio del XX secolo è ritornato in dimensioni globali. Il mondo, il nostro vecchio continente specialmente, dovrebbe imparare dalle esperienze dell'ultimo secolo.
Una ribellione volontarista e violenta contro i problemi dell'egoismo sfrenato nell'economia può avere facilmente per effetto dittature sanguinose che risultano poi tentativi falliti di soluzione di un problema destinato a ritornare. Ma quanti milioni di vite umane sono il prezzo di questi tentativi! But you can arrive with this world view to a common denominator that can provide the minimum necessary for the coexistence and collaboration of individuals and peoples? According to Christian belief, everyone can learn about the essential truths about God through the created reality. We therefore believe in the power of human knowledge even about the basics of life. This is also the basis of morality revealed. Grace, even in this context, presupposes nature. The condition of a symphony about the fundamental principles of morality in several countries, then, knowledge and recognition - also open to the advancement of research and reasoning - the full reality of things objectively exist. The truth, therefore, frees us also about the social life. Thus it appears possible that a balance between a 'healthy' secular state, based on subsidiarity, in matters of worldview, and the possibility of a broad consensus about several key principles. It is this search for balance can be a historical task multicultural Europe. Nuova evangelizzazione quindi, nel contesto della pluralità, del mutuo rispetto, e soprattutto, dell'apertura ecumenica, la quale deve rendere più forte la voce del Vangelo con la comune testimonianza e che deve essere una palestra del dialogo che ci prepara anche al dialogo con le altre religioni e con i non credenti nello spirito della carità e nella verità.
